On a related note, my mechanic has a 2003 530i that needs a motor. Black over tan, auto transmission. In pretty good shape overall, other than some profanity keyed into the passenger side by an ex-girlfriend evidently. He now owns it via a mechanic's lien and wants $1500 for it. If I was confident enough to install a junkyard motor myself, I'd buy it. Would also be a great start for an LSx swap!
Sounds like a good time to talk to an attorney. An obvious case of poor design or lack of maintenance in the car wash (like stopped up drain).
Wow! Saw 2002 and BMW and wondered why it also says 530i. Thought it was one of those crazy Craigslist ads again. Funny how the mind misinterprets data.
I now realize 2002 is the year, not the model.
man I want this..... I have a spare 4.8L LS and a 4l60e too. Planned on going in our 92 volvo 245 but man an e39 would be a nice cruiser as well.
It is a great deal and if he was more local I would go check it out. But I'm done with hauling projects for hours on end, at least for a while.

After looking around a bit more it looks like a running driving e39 isn't all that much more money. 2500-3000 can get you one with higher miles.
The 4.8/4L60e is the same as the 5.3 truck engine just a different piston. The one I have came out of a GM truck...01 I think. I bought it off CL for $600 complete with the trans, accessories, etc etc and it only has 40k miles.
