Dunno if they've had success in litigation but they will sick the lawyers on them if its allowed to continue on their forums.

I'm guessing its not that hard. British Car Forum will boot you in a heartbeat if you break their rules, one of which is bashing a bad vendor. Even if it's justified.
I can see where they might have cause against the person who bought the carfax, but not anyone else.
It's not as if I use Carfax as I've found it to be wrong so many times that I don't consider it to have any value, but it just seems wrong that they would have any recourse whatsoever against a forum or anyone else except the person who paid for the service.

A) I agree that carfax is about worthless
B) If a forum is actively allowing users to swap information in violation of the TOS then there is some accountability on the part of the forum. They cant stop people from making the posts but they can moderate them once it happens.
