Yes, it would be the same.  There's nothing wrong with asking questions.  Ask them for a clear explanation as to why they want proof of what you paid?  An answer of "Because we asked" isn't sufficient.  They should be clear as to why they need it.

They emailed me the relevant section from Mass.gov I posted on page 8. I sent them everything.

Incidentally, we’re asking for a days pay because the accident took out both of my vehicles at night, after Enterprise was closed and I need to be at work by 6:30am

They argued that I didn’t need to take the WHOLE day off. That I should’ve gotten a rental as soon as they opened and gone to work late.

My wife told him that “he couldn’t even rent a NEW rental because you have to get out of the FIRST totaled rental BEFORE YOU CAN RENT ANOTHER ONE! And Enterprise needs the accident report AND claim number before you can get out of this first one in order to rent a new one THAT YOUR DRUNK CLIENT DESTROYED!”

No offense, but this is exactly where some of the issues come in.  From what I am reading, what is it that "the little guy getting screwed by the big corporate insurance company"?  I can't see their file, so I can't say precisely what is going on, but what I can tell you beyond a shadow of a doubt is that they are NOT sitting at their desk saying "How can we screw this guy over?"  In fact, it's quite the opposite.  The faster they can pay what they owe and get it settled, the better.  Trying to "screw" someone would take a ton of time, which they simply don't have.  It sounds to me like they're following Maine protocol for valuing a total loss.  I haven't worked with Maine in years, but reading that statute that's what my guess is.  If they didn't ask for proof of what he paid, then they could get nailed for not following Maine guidelines.  As I said before, the way I read it is that they have to gather that info, but it doesn't mean that's what they'll pay.

I am not saying he is getting screwed by the insurance. Far from it. It apears they are doing there job properly. What I am saying is that considering the media exposure he has had. It would be easy for someone to jump the the conclusion that by putting it out to the media that he feels that he is being screwed by the insurance would some How help when in fact it would probibly have no real bearing on what the payout is going to be and it would only slow the process down.

I saw the report on Fox 25, and it's funny how they missed some details. They said your truck was brand new with 4 miles on it. Nope, more like 12 years old or so, but yeah you only put 4 miles on it. It's funny when they say stuff like that, and the pictures show a different story. Regardless this situation really sucks, and I hope you get it resolved sooner rather than later, and maybe the town or yourself can put up some measures to limit this happening again. Or move somewhere else, but I wouldn't want to do that. I'm sure the insurance companies aren't thrilled with this whole situation either. I forget was the latest driver actually drunk, and if so was he hauled away in bracelets? How has the rental car company been with this whole situation? I imagine not too happy.

Yes, I'm sorry...I forgot you had posted that...I thought it was posted by someone else.  Trying to multi-task...sorry.  They should be able to give you an offer on your vehicle pretty soon, it shouldn't take them long.  Push them for an offer and ask for their supports on it.  I know it's very difficult, but take the emotion out of it.  Yes, their insured was a moron, but it is what it is.  Your wife is spot on as to taking the day off work, and it make sense.  But rational and logical and I think they'd have a hard time arguing your points.  In a normal situation, yes, I'd side with the insurance carrier that you didn't need to take an entire day off work.  However, since their insured destroyed the rental you were already using, it simply wasn't an option for you to just get a rental car.

And again, yes. I’m a bit embarrassed by the misrepresentation of my truck. Hopefully you can picture me saying “My 2005 Yukon Denali was totaled by a gray Honda Accord... twice!” because that was the most insane part to me. I had two of the same trucks, totaled by two of the same cars inside of 4-5 weeks. I must’ve mentioned five times that is was a 2005.

Makes you question most news stories for the accuracy of the details.

I would so be dumping this on my insurance if I was you.  You should not have to be subject to that. That is belittling at best and borderline insulting.   The point is you were at home dealing with accident related issues (yard destroyed, rental car people, your insurance police,  etc etc and you had no car as it was destroyed by there insured so even if Uber was an option you had to be home yes?  Before you wast lots of energy pursuing this you should look and see if they are legally obligated to pay for lost work time in this situation.  I know if you were hurt and missed work it is a whole different story but you were not so I don't think those rules apply.

I live in a small, rural town. I highly doubt I’m getting an Uber to my house at 5:00am. But even if I’m wrong, I had to go to the EBPD, my insurance agent and Enterprise. When she told him that, he said “you should’ve done it for him”. She said “I couldn’t, I have 3 kids, the same kids your drunk client could’ve killed.”

I now have a new claim number. My insurance company suggested I go through them and subrogate the other company. As a 13th Generation Mayflower Descendent, Pilgrim Insurance SUCKS.

Wife tells me how condescending the supervisor was. Which is almost funny because I could tell by what he’d been saying and with what attitude that he was expecting her to cave. He doesn’t know her like I do! 

By the way, the Regional Manager of Enterprise told my wife he was going to (and did) call Pilgrim Insurance and tell them unless I had personally come in to Enterprise with their copy of the police report, I couldn’t have rented a new rental.

Like I said, my wife isn’t letting go of ANY of this. If the guy wasn’t such a berkeleying shiny happy person, I’d feel bad for him.

It is just a complete lack of professionalism on their part.  A complete lack of respect and professionalize.  This is exactly what makes us all hate insurance company and always feel like we are getting screwed by them.  I would file a complaint with the state insurance board and copy them on it.  No embellishment of anything just a concise recount of the conversation's.  With the extreme regulation of auto insurance in this state this may or may not get any attention but it would go on record.  That I bet would go a lot further than just about anything else your wife can do.  

Personably I would just let it all go.  Get this behind you as soon as possible and move on with life.  They suck and will still suck no matter what you do.

Any follow up from the town or anything about the news story?

You could say that, yes!

We ended up with 47x the first offer for lawn repair (yes, 47x).

And $2,200 more than their first offer for the Denali.

Never underestimate the power of a very smart yet pissed off woman.

For the record: the Pilgrim adjuster’s supervisor’s supervisor was VERY NICE and did well by us.

My insurance companies (Plymouth Rock) total loss adjuster who we asked to act on our behalf was FANTASTIC. I can’t say that strongly enough.
