All of the speculation above can be true and it changes nothing. It's a work place accident so it's covered under workman's comp. Period. The family can not sue the dealer even if they're negligent because it's covered under workman's comp, well they can, but they'll lose, because it's already settled. The only workaround (if you can call it that) is what they are trying here.

I'm not overly familiar with Canadian laws. It's just the concept that the poster was saying that I disagree with.
I'm not at all surprised they are bringing in the vehicle owners carrier. They are likely going to argue that the driver had permission to drive the Jeep and therefore qualifies for coverage under the policy. Depending on policy language, they may not be wrong.
