I'm curious, when an employer requests a drivers record, what do they see?
For instance, I had my first speeding ticket in probably 10 years just as I was returning home from my honeymoon in September. It was a doozey, and would have slapped me with quite a few points.
Through the great work of a fellow GRM member and a referral to an attourney, the entirety of my points where dropped and my fine reduced to half. I still have a speeding ticket on my record, but its for 5mph over and no points.
Does my potential employer see the original violation, or just the final judgement?
If you're applying for a job as a driver it may be relevant. Does he have the right to ask?
Did he also do a background check or security clearance?

It would be the final judgement. The state doesn't get the info until the matter is adjudicated.

Ok that clears it up.
Basically, you could get pulled over and arrested for speeding while DUI without a license, but if you were found completely innocent, nothing would ever appear on the DOT driving record, correct?

It's the final judgement.
But, he probably won't see anything for a violation 10 years old (depending on the state).
GA has a choice to do a 3 yr or a 7 yr MVR report. The contract we were working under required a 5 year, so we always asked for a 7 year.
We saw the final judgements, only for the period requested. If an employee erred and requested a 3 year, that's all we saw.

According to the Ohio Bureau of Motor Vehicles:

There is no section of the ORC that states convictions ever come off of a driver record. However, an administrative decision is in effect that allows for Driver Abstracts to only reflect the last three years driver record activity.
Sounds like OH retains points for 2 years, and shows violations for 3 years on a report (abstract), but the actual record of the violation is permanent.
I realize you are there and I am not, and you have a background in police work and I don't know crap, but still...
