I'm trying to get a trademark, or more accurately, a servicemark for the name of our band (Colebrook Road). We filled out the applcation, and said the category was "Entertainment in the form of live music concerts," which is what a band does- play music for people live. As proof of interstate commerce, I submitted a 'specimen' that was our name, among others, on the bill for a festival in West Virginia. They rejected the application and said that the specimen didn't accurately show anything, and that the service we rendered was not made clear in our name.

I can't very well change the name of the band to "Colebrook Road we play live bluegrass music." I know band names are successfully trademarked all the time. And our "business" is 5 dudes playing music on the side, we don't have thousands of dollars for trademark attorneys- matter of fact you couldn't even buy a crappy E30 with the money we make in a month. Anyone have experience dealing with this particular sprawling bureaucracy?
