Long story....

 

My parents bought a car from my ex BIL.  They never got the title.

 

My BIL does not have the title.

 

How do we get a title so the car can be registered in SC?

 

It seems that Arizona wants the car to be there in person to get a replacement title....

 

Any help is greatly appreciated!

Ask if you can get the VIN inspected by a police officer.  Here in FL they have a form for it that also allows a notary public to inspect the VIN.  That also applies to out of state LE and notaries at least for FL.

Every state has a process.  Probably involves a small fee to have AZ DMV research the title there, then some affidavit that you did A, B, and C and then they'll issue you a title.

I had to do that with a boat in PA from MD that didn't have a title.  I had to pay MD $5 to pull the last three owners, I had to send them return-receipt letters, and post an ad in the legal section (old school) of a publication.  It was supposed to take 90 days, but the nice lady at the MD boaty registration place had a title in my hand in a couple weeks.

This is where it is likely best to begin the process.  If AZ sees the B-I-L as the rightful owner, as the rightful owner he likely needs to be involved in completing a "genuine AZ sale" before SC will let you proceed forward.

As mentioned, every state is different but I think your first research should be how b-i-l can obtain a copy of the title from AZ.  I am in Ohio but here in Ohio, I can show up at the County Clerks Title Office with proof of id and $18 I can walk out with a replacement title.

AZ might be as cheap as $4 but this would be the b-i-l requesting this, not the parents requesting it.  

 

It also seems that modern cars in AZ only have Electronic Titles.  See more on the e-titles here.  The key take-a-way here might be that the b-i-l doesn't have a tile because in the modern era, AZ does not generate paper titles until your request them.  Unlike the old days, there may not be a title in your purchase paperwork from when he bought the car.

Let's just say the BIL is now an ex BIL and maybe not a likely path to go down...

 

However, I WAS able to sign up for the AZ DMV and request a title to be sent to my BIL for the 4$ mentioned above.  I just needed the VIN and his name and it let me in as if I was him....  no verification or personal info required.  Also, it let me see past transactions...  It seems their system is not very secure.  I didn't even need to act like I was him or verify that I was him.  Just title and name.  (Oh, and maybe birthday).  Weird.

 

At least the title will be in the same town as the car at that point.

Cool.  You mention past transactions.  Does it look like the estranged b-i-l is the sole owner?  No lien on the car?

T hats one of the excellent things!  It says it is a clean title.  No liens.  It even says "can be transferred" or something like that.

Well it sounds like you may have the problem licked.  I can tell you SC can be a bitch titling vehicle.
