He very well may have been. Then again, he should have accepted the first "no".
Sad state of affairs, whether the ice cream guy was up to no good or not. We'll probably never know, as he'll move on to somewhere where the heat ISN'T and do whatever he has planned, whether that be to sell ice cream or prey on little kids.
Similar story, again from real life/ my neighborhood. I had to have the stranger danger talk with our 4 year old the other day- some guys pulled up to a bus stop and offered to give two little girls a ride up to the house (200 yards from the road, maybe)- an attentive bus driver took down a tag number, called it in, and most importantly STAYED THERE to make sure the kids got up to and into their house.
In related news- yes, it sucks to be a man anywhere you might have to deal with little kids. Dropping off/ picking up my own kids at the daycare/preschool I occasionally get the stinkeye from some mom- it's almost like they feel like I'm not supposed to be there- just because I'm a man.
I'm confused - your nephew was afraid he was going to be kidnapped by the ice cream man and after a recognized adult showed up offering safe haven he still bought an ice cream from the guy? Was this his way of keeping the guy around while the police came? I think you should tell your nephew that if something like this happens again that he should just get the hell out of there.

Yes, but to be honest with you the kid REALLY likes ice cream.

Actually he said his "That's my mom" rouse needed to be complete, and he claims it would be normal for him to buy ice cream in that situation. He is an extremely bright 12 year old that has been raised as a free thinker.
