Currently approaching week 7, after the accident, without even being notified by the at fault insurance company that they or we need to get estimates on the damage.

We have. And they want deductible plus loss of potential medical bill coverage. So they are being just as big a douchenozzle as the other company.

Why is your company being a douchenozzle for asking you to cover your deductible? That's what you chose when you got your policy. What do you mean loss of potential medical bill coverage?

Shouldn't be my ins co footing the bill, jmo, and that is what our agent is telling us.

In the long term, you're correct. Your company doesn't want to be left with the bill either so if you go through your own company they will do everything they can to recover the money they pay out...and your deductible. So if you need to use your coverage, do it. That's part of the reason you have it. The deductible is what it is. Sucks to lose that money, but hopefully you'd get it back.

As for the other carrier, have you heard from them? What are they telling you? Seven weeks is waaaaay outside the normal, unless something else is going on. Call them, ask questions.

Honestly letters from attorneys don't scare insurance adjusters into doing something different or faster than they normally would. When an attorney gets involved, it typically makes a claim go slower, not faster.

Had a deal like that once. My insurance adjuster gave me the phone number of the state insurance board, or what ever it is called. His insurance adjuster contacted me almost immediately. He wondered why I contacted the state.

Most states have laws regarding the time allowance for settling a claim. Contact the state insurance department and you'll find out what your rights are.

Exactly what I was thinking. SWMBO was rear ended last Thursday, we have been playing phone tag with the adjuster already. Small accidents (no injuries) are usually settled very quickly.

How long will it take? How bad is it? How busy is the shop the car is at? How motivated is the insurance company? Odds are the car above would take a few days to buff out.
