Sold a Yamaha Waverunner - new owner wants to return it.....

Thanks guys, if I can manage to take a step back I can realize how ridiculous of a situation this is but in the moment it's stressing my wifes parents, my wife and myself to no other. She keeps texting me claiming she video tapped the whole sale to prove it was fraudulent. Now shes rambling about something about me not having a POA? Who knows. She called me again from the tax collector saying the whole thing was fraud so I politely asked to talk to the clerk. I explained the whole situation and shes like , "oh, that's not a big deal..just send a copy of the drivers license and we can get this taken care of". So we're sending that and they can be on their merry way. If they acted somewhat reasonable I could have been coerced into having this ski fixed or return money but now I realize something else is going on here. I think they did something to the ski on Sunday and they are trying to back out of the sale. Otherwise why wait to call me at 10pm and not call me when they first got on the water?

Sigh.

For the record I sold it for just over $3k.

Call their bluff. Don't talk to them. Only talk to official people.

Guess what? Clerks, cops, and judges spend a lot of time dealing with shiny happy person scammers like this. They also deal a lot with well meaning people who slip up slightly and forget to cross a T or dot an I or two. They can tell the difference. Guess who's side they're likely to be on and help work things out? Hint: it's the one who wants to make their lives easier, not harder.

Not to pile on, just trying to help in this stressful situation. Are you taking it, physically, to the Tax Collector or are you faxing/emailing it? I would NOT fax or email, but go directly to the office and speak to the same tax collector. It would be easy to fake a tax collector via the phone and to give you fake phone numbers/email addresses.

Again, you've probably already thought of that, but thinking straight in a stressful situation is hard to do.

BOS always signed and noted to say ASIS Where IS. If I can't get a copy of a hand written one, I take a picture and upload to the cloud. Cell phones are great things.

Now I'm starting to wonder if they are attempting to get more information from you in order to steal your identity. Be careful!

Who would want his identity? Apparently he has to deal with idiots harassing him on the phone all the time. No one needs that.

And, yeah, you have it on good authority from Mr. Franklin in your pocket that this transaction is concluded. You've acted in good faith to resolve a few confusing issues regarding the paperwork, but at this point fixing slight issues appears to not be their goal. Block calls. Move on.

They're county is 2 hours away but I've separately confirmed fax and emails as correct. I think we're finally getting to the bottom of this because the questions have shifted from fraud/prosecution/refund to can we get some money for repairs. If she wouldn't have pulled the wacko card I would have helped them get the situation fixed from my dealer but now as soon as I figure out title has been transferred I will be ignoring all future correspondence.

I figured you had confirmed as GRMer's are normally a little smarter than the average bear, but also knew you were stressing about this and wanting to end it quickly.

I've been there and done that (sold a very beat 12 year old 230k mile Mitsubishi to some woman for $650, then got angry phone calls and threats of legal action a few days later). Ignore it, I'll bet nothing ever happens, if it does, you're in the clear anyways and might get to see a judge laugh at someone.

Next time they call, pull a Craigslist and have a friend say, "New phone, who dis?"

I had a similar title situation, from the other side. A longtime friend of mine gave a car to my sister that had just graduated high school. The car was older and high mileage, but owned since new in perfect shape. The car sat at my house for a year or two, waiting for her to get her license. She never showed much interest, so it was decided to give the car back (my friends son moved back and had the need for the car.) About a day after the car was returned, our loser druggie alleged father decided he wanted it. He forged his daughter's signature, and put the car in his name without her consent or knowledge. He came to get the car and the police were involved. Everyone knew he forged the paperwork, but nothing could be done unless the previous owner of record, my sister, pressed charges. She was upset, but wouldn't press charges against her father, so he got away with it.

I'm very suspicious of your buyer's claim that the DMV said the papers were forged. They simply wouldn't care, and could do nothing, unless the previous owner of record made the claim. So unless your father in law is going after you or his daughter, you are clear.

BTW, deadbeat dad totaled the car a week later and abandoned it.

Exactly, I've had some questionable signatures on past purchases where the seller signed in the wrong spot or something and those clerks dont give a damn. They aren't penmanship experts. I think that was just another ploy to try to get what they want. Either way, we're past that and in the home stretch.
