8 years in prison? I'm no advocate for child molestation, but isn't that a bit excessive in this instance? There doesn't seem to have been any malicious intent, and I didn't see any indication that there was physical contact of any kind.
Our legal system is a bit berkeleyed.
It seems like (and this might be over symplifying things...) that if I were playing a drunken game of water balloon fight with a friend and I mistakenly threw a water balloon at an unintended stranger, I would be charged with Assault and Battery within 10 seconds.

Besides which, if the roles were reversed and it was a 42 year old guy doing that to a 12 year old girl you'd probably be saying 8 years isn't enough.

'42 y/o woman fondles 12 y/o boy at party, offers to perform oral sex.' She's looking at 8 years in prison, probably out in 2 or so on good behavior.
'42 y/o man fondles 12 year old girl at party, offers to perform oral sex.' He might as well plan on dying behind bars.
I don't advocate child molestation either. There does need to be parity in punishment.

I'd be asking the parents why their 12yo was at a party with a bunch of drunk 40yo people. I try to keep my preteens out of that situation to start with. Drunks, as a rule, don't have a whole lot of inhibitions.

I'm not sayin' a little talkin' to about line crossing when on your second bottle of red isn't warranted but... damn. I just read in the paper this AM that a guy who stabbed two people in a bar fight he started over heroin possession or lack thereof faces up to 3ys in prison.
The lesson here is don't try to berkeley them, try to kill them.

While our legal system is messed up, this women is whacked as well. She thought it was some other man......who exactly was this married woman after if not the child? She's got issues. 8 years is about right. 3 years for bar fight stabbing is a little light.
