LONGLONGLONG story short. My sis and brother in law have been seperated now for about 8 years. He has been paying child support and sis, being a certified headcase (servere bipolar) is on disability.
My mom got custody of my neice about 4 years ago when my sister hooked up with this loser (also a fellow with bipolar disorder) and moved to Carlisle. My niece didn't want to go and live on somebody's couch (sis and b/f do not even have a bedroom to themselves) and child services got involved and my mom took legal custody to keep the kid out of fostercare.
all well and done..
Now the father is playing games with the support. Mom has been getting it for the past 4 years and now he wants my sis to pay half.. Sis makes 200/month on disability and 200/month in food stamps. He is so insistant that she pay half that he is taking this to court.
The really stupid part is.. he only claims half his income.. the other half is under the table. Sis has proof of this and it will come out in court. We have tried to warn my bil that he is not only going to lose, but he is probably going to cost himself and all his co-workers a job when the IRS comes knocking and demands to know why all the employees only get paid half on the books.
I really want to know why he even thinks he can win.

They don't deduct from disability payments.. and she only gets 200/month

He knows sis will let the cat out of the bag about his earned income.
How can anybody be so stupid as to persue this because somebody he knows told him he can win and lower his payments? It's bad enough he is an alcoholic and got nailed for two DUIs in the same week, in the same town, by the same cop... but now he is about to open up a HUGE can of whoopass on himself when the courts just smile, nod, and explain to him in nice legal terms what an idiot he is.
Someone should let the ex-BIL's coworkers and employer know whats coming thier way, they'll deal with it on their end.

The IRS is pretty good at figuring it out. I've seen it happen a few times.
How can you be so stupid to not realise that you are at the end of the day only hurting a child by not paying your support. That is the part that gets me. People seem to forget tgatvthere is a kid that will probably have to live with less. These people need to be sterilized.
Everyone has about got it covered. Can't fix stupid. The child is the one that will suffer. Even if your mom doesn't need it, the kid will see what is happening and it will affect the child. Also, in my experience, fathers usually come out on the losing end anyway. It's possible that not only will he lose and his unreported income be brought to light that will cause him issues with the IRS, the child support payments will most likely be increased also.
It's really unfortunate that spawning a child is so easy. Can we offer an exchange of the ability to reproduce for 1000 lotto tickets?

when he and my sis were living with me after they got married.. I remember coming home from work at 5am and finding him laying on the floor in the middle of the hallway... still in his jacket and boots and having E36 M3 himself...
The only reason he never got tagged for DUI was that he became a VERY careful driver when drunk. I thought it was fitting that the same cop got him twice in the same week. I would have loved to have been a fly on the wall.
And no, my mom needs the help. She is on a fixed income. I have been helping out these past few months as I have become my neice's father figure instead of her biological father.

The even funnier thing is that, unless your state is way different than mine, even if he gets an order for your sis to pay (highly unlikely, since she's on disability), it likely won't reduce his own obligation. In Michigan, and most other states as far as I know, each parent's obligation is independent of the other's. If her disability payment is SSI, likely it won't be attachable for support. If its SSD (does she have a work history?), she should look into whether there is a derivative benefit available to the child. If there is, that benefit will likely exceed anything she would be ordered to pay by the Court and, here at least, would be accepted by the Court in lieu of support.
On the other hand, cash under the table is tough to prove in Court. Did your sister do the household books while they were together? If not, about the only way to prove cash under the table is to "Al Capone" him. (Lives large, claims to make next to nothing) I've had some recent success in Court under that theory because our biggest group of "cash under the table earners" (drug dealers) like to post photos of themselves on Facebook with their giant wads of $20 bills.
Yep, you can't fix stupid and it gets to the point where there is no sense in trying. Unfortunately some people are just determined to trash their lives. There was an Offspring song about that, 'She's Got Issues', my favorite line: 'I don't know why your whole life is such a chore' and it applies to guys just as much.

This is one thing that most may not realize. If they have been an alcoholic for long enough they actually become good at driving drunk. I have know a number of people like this (one reason why I don't tolerate alcoholics well anymore)
I know someone who is a hard core alcoholic, would drink during the day, and was a delivery driver!
I think it has something to do with the fact that they live in a world where they are more drunk then sober and the drunk "person" becomes more of the actual person and learns what it needs to survive. Quite sad of course.

I will let everyone know in two weeks how badly he got boned by the judge. I have to take my mom into court as she refuses to drive into the city

As a general rule, you're right. I have seen a few, though, who have at least a couple grand in their hands. Now that's not to say it actually belongs to them. Most of it goes up the chain of distribution to someone who actually is as gangster as most of these goofballs what to pretend they are.
BTW - for the uninitiated, if you want some examples of what we're talking about here, go to facebook, put in some variation of "Trap" (I.e. Trapstar, Trapoholic, school= "studied at the trap", work = "the trap", etc) and your home city to find the local collection of goof-ball wanna-be/two-bit gangsters.
